Terms of Service

TL;DR — Play our games, have fun, don't cheat or abuse the service. We may update or shut down games at any time. Don't use Funcoded if you're under 13 (or under 16 in the EU). The full terms are below.

1. Acceptance

These Terms of Service (the "Terms") form a binding agreement between you and Funcoded, LLC, a California limited liability company ("Funcoded", "we", or "us"), and govern your use of our websites, games, and related services — including funcoded.com, the Busted Wheel, Bubble Flubble, and any future Funcoded games or features (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility & age

You must be at least 13 years old to use the Service (16 in the European Economic Area and the United Kingdom, or the minimum age for digital consent in your country, whichever is higher). If you are under the age of majority where you live, you confirm that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

3. Accounts

Some features require an account. You can sign in via Discord, Apple, or Google. You are responsible for the activity on your account and for keeping your sign-in credentials confidential. You agree to provide accurate information and to update it as it changes.

4. License to use the Service

Subject to these Terms, Funcoded grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own non-commercial entertainment.

5. Acceptable use

You agree not to:

We may suspend or terminate accounts that violate these rules, with or without notice, and may remove offending content.

6. Your content

Content you submit (display name, avatar, scores, etc.) remains yours. You grant Funcoded a worldwide, non-exclusive, royalty-free license to host, display, store, reproduce, and distribute that content as necessary to operate and promote the Service. You represent that you have the rights to the content you submit.

7. Purchases & virtual items

Some features may be made available for purchase. Purchases of virtual items, in-game currency, or premium features grant a personal license to use those items within the Service — they have no real-world value and cannot be redeemed for cash. All purchases are final unless required by applicable consumer law. Where you purchase through a third-party platform (Apple App Store, Google Play, Discord, etc.), that platform's terms and refund policies also apply.

8. Third-party services

The Service integrates with third parties — Discord, Apple, Google, hosting/infrastructure providers — to operate. Their terms and privacy policies apply when you use their parts of the Service. Funcoded is not responsible for third-party services or their content.

9. Availability & changes

We may add, modify, or remove features at any time without notice. The Service may be unavailable from time to time for maintenance, upgrades, or events outside our control. We may shut down individual games or the entire Service.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service immediately if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (e.g., warranty disclaimers, liability, governing law) will continue to apply.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. FUNCODED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FUNCODED'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. FUNCODED IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

13. Disputes & governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in California, and you consent to that jurisdiction. If you live outside the US, mandatory consumer-protection laws in your country may grant you rights that override this section to the extent applicable.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above and, where the changes are material, give you reasonable notice (e.g., a prompt in-Service or by email). Continued use of the Service after the updated Terms become effective means you accept them.
